1. Agreement to Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("Client," "you," or "your") and Bloom Quartz Pocket ("Company," "we," "our," or "us"), a photography business registered in the United Kingdom with Registration No: 59176896, located at Flat 31e Miller Squares, West Neilhaven OX11 8JJ, United Kingdom.

By booking our services, accessing our website, or engaging with our photography services, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use our services.

2. Services Provided

Bloom Quartz Pocket provides professional photography services including but not limited to:

3. Booking and Reservations

3.1 Booking Process: To reserve a photography session, clients must complete a booking form and pay the required deposit.

3.2 Deposits: A non-refundable deposit of 30% of the total package price is required to secure your booking date. This deposit is applied toward your final balance.

3.3 Date Reservation: Your session date is reserved only upon receipt of the deposit and signed agreement.

3.4 Availability: Session availability is subject to our schedule. We recommend booking 6-12 months in advance for weddings and 2-4 weeks for portrait sessions.

4. Payment Terms

4.1 Payment Schedule:

4.2 Accepted Payment Methods: We accept bank transfers, credit cards, and debit cards. All payments are processed securely through authorized payment processors.

4.3 Late Payments: Failure to pay the balance by the due date may result in cancellation of your booking and forfeiture of your deposit. We reserve the right to withhold delivery of final images until full payment is received.

4.4 Additional Charges: Any services or products requested beyond the original agreement will be invoiced separately and must be paid before delivery.

5. Cancellations and Rescheduling

5.1 Client Cancellations:

5.2 Rescheduling: One free rescheduling is permitted if requested at least 14 days before the original date, subject to availability. Additional rescheduling requests may incur a £50 fee.

5.3 Company Cancellations: If we must cancel due to illness, emergency, or unforeseen circumstances, we will attempt to provide a replacement photographer of equal caliber or offer a full refund including the deposit.

6. Session Guidelines

6.1 Arrival Time: We will arrive at the agreed time. Delays in client arrival may reduce session time without price adjustment.

6.2 Session Duration: Sessions are limited to the agreed timeframe. Overtime may be available at our discretion for an additional fee of £100 per hour.

6.3 Location: Clients are responsible for obtaining necessary permits or permissions for photography locations. We are not liable for denied access to locations.

6.4 Weather: For outdoor sessions, we will reschedule due to severe weather at no additional charge. Light rain or overcast conditions may still allow for beautiful photography and are not grounds for automatic rescheduling.

6.5 Conduct: We expect professional and respectful conduct from all parties. We reserve the right to terminate a session without refund if subjected to threatening, abusive, or inappropriate behavior.

7. Copyright and Usage Rights

7.1 Copyright Ownership: Bloom Quartz Pocket retains full copyright to all photographs created during your session. This includes RAW files, edited images, and all derivatives.

7.2 Client License: Upon full payment, clients receive a non-exclusive license to use delivered images for personal purposes, including:

7.5 Model Release: By booking our services, you grant permission for us to use your images for promotional purposes. You may request certain images be excluded from public use.

8. Deliverables and Timeline

8.1 Image Delivery:

8.2 Delivery Method: Edited images are delivered via secure online gallery with download access. Gallery access remains active for 90 days after delivery.

8.3 Image Count: The number of edited images delivered depends on your package and session length. We deliver all high-quality images from your session, typically:

8.4 RAW Files: RAW files are not included in standard packages and are not available for purchase. All images are professionally edited before delivery.

8.5 Backup: We maintain backup copies of edited images for 2 years after delivery. Clients are responsible for downloading and backing up their images from the online gallery.

9. Editing and Retouching

9.1 Standard Editing: All delivered images receive professional editing including color correction, exposure adjustment, and basic retouching.

9.2 Advanced Retouching: Extensive retouching (beyond blemish removal) is available as an additional service at £25 per image.

9.3 Image Selection: We select and edit the best images from your session. Clients do not receive unedited proofs or the ability to choose specific images for editing unless this service is specifically purchased.

9.4 Editing Style: Our editing style is consistent with the portfolio examples on our website. We do not substantially alter our editing style to match other photographers' work.

10. Print Products and Albums

10.1 Print Orders: Prints, canvases, and albums can be ordered through us. All products are fulfilled by professional labs and carry their respective warranties.

10.2 Production Time: Print products typically require 3-4 weeks for production and delivery.

10.3 Color Variations: Colors may vary slightly between screens and prints due to device calibration differences. We cannot guarantee exact color matching to client screens.

10.4 Print Release: Clients may obtain prints from third-party vendors using their digital files, though we recommend our professional printing for best quality and color accuracy.

11. Liability and Limitations

IMPORTANT: Please read this section carefully as it limits our liability.

11.1 Equipment Failure: We maintain professional backup equipment. However, if equipment failure prevents capture of key moments, our liability is limited to a full refund. We are not responsible for consequential damages.

11.2 Missed Moments: While we make every effort to capture all important moments, photography is inherently subjective and unpredictable. We cannot guarantee capture of every specific moment.

11.3 Maximum Liability: Our total liability for any claim relating to our services shall not exceed the total amount paid for the photography package.

11.4 Third-Party Interference: We are not responsible for limitations on photography due to venue restrictions, officiants, coordinators, or family members obstructing shots.

11.5 Force Majeure: We are not liable for inability to perform services due to circumstances beyond our control including but not limited to natural disasters, illness, accidents, or government restrictions.

11.6 Data Loss: While we maintain multiple backups, we are not liable for data loss due to circumstances beyond our control. Clients should download and backup their images promptly.

We collect and process personal information in accordance with our Privacy Policy and UK data protection laws (UK GDPR). By using our services, you consent to such processing and warrant that all data provided is accurate.

14. Disputes and Governing Law

14.1 Governing Law: These Terms shall be governed by and construed in accordance with the laws of England and Wales.

14.2 Jurisdiction: Any disputes arising from these Terms or our services shall be subject to the exclusive jurisdiction of the courts of England and Wales.

14.3 Dispute Resolution: We encourage clients to contact us directly to resolve any concerns. We are committed to addressing complaints promptly and professionally.

15. Modifications to Terms

We reserve the right to modify these Terms at any time. Updated Terms will be posted on our website with a revised "Last Updated" date. Bookings made before changes take effect are governed by the Terms in effect at the time of booking.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining Terms remain in full force and effect.

17. Entire Agreement

These Terms, together with any signed service agreements and our Privacy Policy, constitute the entire agreement between you and Bloom Quartz Pocket regarding our services and supersede all prior agreements and understandings.
